What Is a Responsible Person?

The role of the Responsible Person is defined within the Regulatory Reform (Fire Safety) Order 2005. The Responsible Person is legally obliged to protect the safety of all persons within a building, including employees, residents, customers, and visitors, in relation to fire prevention and fire safety management.

This responsibility covers a wide range of duties, including:

  • Fire risk assessments
  • Evacuation procedures
  • Maintenance of fire safety assets
  • Ensuring fire exits remain clear and operational
  • Day-to-day fire safety management

 

These duties are ongoing and must be actively managed, not simply documented.

Understanding Your Legal Duties and Liabilities

Understanding the scope of your responsibilities is critical. These are not theoretical obligations; they are legal requirements. The consequences of non-compliance can be significant, even if a fire does not occur.

Responsible Persons can be held accountable for failures in fire safety management, which may result in enforcement action, fines, or potentially criminal prosecution.

Where fire safety duties are delegated to managers or staff, those individuals may also hold legal liabilities under the Regulatory Reform (Fire Safety) Order 2005. However, the ultimate responsibility always remains with the designated Responsible Person.

We validate our Responsible Person Training for 3 years on the understanding that regulations can change. You should undertake this training as frequently as you feel necessary bearing in mind that your employees may change through staff turnover and thus new applicable employees may benefit from this training.
